Declaration of Operational Balancing Order 

 

This Operational Balancing Order is only effective for Intrastate Firm Transportation Agreements that have this provision in the agreement, including the Statement of General Terms and Conditions for Transportation Service that is part of the agreement (the “Statement”).  

Kinder Morgan Tejas Pipeline, LLC, Kinder Morgan Texas Pipeline, LLC and Kinder Morgan Border Pipeline, LLC (“Kinder Morgan”) hereby notifies transport customers that an Operational Balancing Order is in effect as of 9:00am central time January 18, 2025, and until further notice due to one or more of the following conditions being met:

(1) There is an extreme weather or operational event that has resulted in the Gas Daily Price for the next gas day increasing by fifty percent (50%) or more from the price for the “Monthly Bidweek Spot Gas Prices” East Texas, Houston Ship Channel” index as reported in the first publication of this month's issue of Platts INSIDE FERC'S GAS MARKET REPORT® (as published by S&P Global); and/or

(2) There is an extreme weather or operational event that has resulted in the Gas Daily Price for the day increasing or decreasing by fifty (50%) from the previous day's Gas Daily Price.

While the Operational Balancing Order is in place, the Imbalances provisions of applicable agreements are suspended and all receipts and deliveries under transportation agreements are required to be balanced.  During the Operational Balancing Order, any daily negative imbalance will be sold by Kinder Morgan to Shipper at a price equal to the highest Gas Daily Price for the month in which such imbalance occurred and any daily positive imbalances will be purchased by Kinder Morgan from Shipper at a price equal to the lowest Gas Daily Price for the month in which such imbalance occurred.  

Kinder Morgan will post a notice once the Operational Balancing Order ends. 

 

Additionally, during this Operational Balancing Order event, Kinder Morgan will continue to evaluate all Interruptible activity across the system, including both transportation and storage activity. Additionally, point operators as well as shippers must keep scheduled quantities in line with physical flow in order to prevent reductions. Shippers are encouraged to rank their nominations should reductions become necessary.
