11/04/2024 Sea Robin West Revision to Notice of Force Majeure (FM) As previously noted, the operator ("Plant Operator") of the Sea Robin Gas Processing Plant ("SRGP Plant") shut in the SRGP Plant on November 1, 2024, at 9 a.m. Pursuant to Section 3.2(d) of the General Terms and Conditions of Sea Robin's Tariff ("GT&C"), Sea Robin has the right, but not the obligation, to process Shippers' gas to allow it to meet the minimum gas quality specifications of, and thus be delivered into, downstream pipelines. Sea Robin on the West system had been utilizing the SRGP Plant to dehydrate Shippers' gas for this purpose. However, as a result of the actions of the Plant Operator, Sea Robin can no longer arrange for the necessary processing of Shippers' gas and thus has been unable to deliver gas that meets the quality requirements of downstream pipelines. In accordance with Section 3.2(b) of the GT&C, each Shipper is responsible for the separation, treating, dehydration and/or processing of its Pro Rata Share of volumes prior to delivery by Sea Robin on the West system at the Point(s) of Delivery so that volumes transported can meet the quality specifications at downstream Points of Delivery. Accordingly, the shutdown of the SRGP Plant by the Plant Operator does not constitute an event of force majeure under Sea Robin's Tariff and Sea Robin will schedule appropriately nominated volumes provided, however, that Sea Robin will not schedule nominated volumes unless the Shipper submitting the nomination provides documentation to Sea Robin that it has arranged for the nominated quantity of gas to be dehydrated to the extent necessary to meet the gas quality specifications of downstream pipelines prior to delivery to those downstream pipelines.
