Subject: Regional Energy Access (REA) Update
Today, the U.S. Court of Appeals for the D.C. Circuit denied Transco’s petition for rehearing of the Court’s decision remanding and vacating the certificate orders issued by the Federal Energy Regulatory Commission (FERC) for our Regional Energy Access (REA) Expansion. While the mandate effectuating the Court’s decision to vacate the REA Project certificate is scheduled to take effect on January 28, 2025, Transco has pending before FERC an application for a temporary emergency certificate, which would allow Transco to continue to operate the REA facilities until FERC issues an order on remand from the Court’s decision. In numerous prior cases in which a federal circuit court has vacated a certificate for an “in-service” pipeline, FERC has issued a temporary certificate in order to prevent disruption in service to customers who use the capacity.
